State and National Criminal History Record Check

• Who needs a background check?

  Each individual applying for a license application must submit to the required fingerprint-based state and national criminal history record check for licensing consideration. An individual who has been convicted of a felony violation of article 57 of chapter 21 of the Kansas Statutes Annotated, and amendments thereto, or a substantially similar offense in another jurisdiction, within the immediately preceding 10 years, is not eligible for initial or continuing licensure as a hemp producer.

• What needs to be submitted?

  Completed fingerprint cards, waivers to submit to the state and national criminal history record check, and $47 per person must be sent along with the license application by the application deadline. KDA will submit them to the Kansas Bureau of Investigation on behalf of all applicants and will conduct the background check. You can request fingerprint cards and waivers via the form below.

• When are fingerprint cards and waivers due?

  Completed fingerprint cards and waivers must be received by the application deadline date each year. They will be used by KDA to receive state and national criminal history record check. A state and national criminal history record check must be provided to KDA from the KBI; a state or national criminal history record check submitted by an applicant directly to KDA will not be accepted.

• How do I get a fingerprint card and waiver form?

  They can be provided at your local law enforcement agency. Please thoroughly read these instructions for completing the fingerprint card, and print and take this Waiver Form when you go to be fingerprinted. Do not sign it ahead of time; the Waiver Form must be signed in the presence of the person taking your fingerprints. You can also request to have them sent to you via the form below.
  

• What do I do if my local law enforcement agency won't release my fingerprint card back to me?

  • The fingerprinting agency will need to send the fingerprint cards and waivers to KDA so it can be paired with your application. 

  • Have the fingerprint card and waiver sent to: Kansas Department of Agriculture, c/o Commercial Industrial Hemp Program, 1320 Research Park Dr., Manhattan, KS 66502. 

  • You are responsible for the cost of mailing such documents.
    

• What happens if my submitted fingerprint card is returned to the KDA as illegible?

  • Complete a new and legible fingerprint card immediately and send the fingerprint card and completed waiver to KDA.
